SACRAMENTO, CA - The California Highway Patrol says talking on the phone is more dangerous then talking to a passenger because a passenger can respond to dangers on the road and help you versus someone on a phone who doesn't see what you are doing on the road.
But CHP Officer Adrian Quintero does say passengers should be mindful of not talking on the phone or distracting the driver. And they can help with navigation and answering texts.
Quintero also reminded teen drivers can't have younger passengers in the car with them.
Quintero says while you can't be cited for not using a hands-free phone, you can get a ticket for "other" if it causes you to drive in a distracted manner or is a contributing factor in an accident, such as putting on make-up while driving.
