California court to rule if it is unconstitutional to outlaw same-sex marriage

SACRAMENTO, CA - The Ninth Circuit Court of Appeals expects to rule Tuesday if Proposition 8 is unconstitutional.

Proposition 8 outlawed same-sex marriage in California.

The court heard arguments more than a year ago, but delayed its decision until it could figure out whether supporters had the right to defend Prop. 8.

No matter how the court rules, both sides said they will appeal to the U.S. Supreme Court.
